Stuttgart AR PD Officer Mayhorn BWC 10/08/23 Welfare Check At Southside Baptist Church For DWI

I, Officer Mayhorn was dispatched to the Southside Baptist Church for a welfare check. Was stated that there were two subjects, one on the ground and one passed out in the vehicle. I approached the vehicle, Jeffery Oxner was on the ground on his hands and knees.I asked if they were alright, April Oxner, was in the driver seat, then woke up and stated that she was too drunk and pulled over. She then took the keys from the ignition and put them in the console. The vehicle was in the grass in front of the church well off of the road.I approached the drivers side of the vehicle. I opened the driver door and asked Ms. Oxner to step out. She was unable to stand and wanted to sit down. I attempted to look for her ID, there was a smell of intoxicants from Ms. Oxner. I picked Ms. Oxner up and detained Ms. Oxner and placed her in my patrol unit. I went back to the passenger side of the vehicle where Mr. Oxner was, he was vomiting and was dizzy and could not stand. Sgt Jackson and Cpl Stewert arrived on scene and Sgt Jackson requested an ambulance for Mr. Oxner. Sgt Jackson and myself searched the vehicle and found three open containers of alcohol. There was an ice chest behind the passenger seat that contained alcohol. Mr. Oxner stated that the open containers were his. Once the ambulance arrived to transport Mr. Oxner to the hospital, I read Ms. Oxner her rights and placed her under arrest on suspicion of driving while intoxicated. Cpl Stewert went to the hospital with Mr. Oxner. I brought Ms. Oxner to the police station to start observations. Sgt Jackson administered the PBT, Ms Oxner's BAC was at 0.128%. Sgt Jackson performed the SFST on Ms. Oxner. Sgt. Jackson started with the Vertical Gaze Nystagmus, Ms. Oxner moved her head as well after given instruction to only move her eyes. The Vertical Gaze Nystagmus was evident in both eyes. Sgt Jackson then asked Ms. Oxner to stand on one leg and count until told to stop. Ms Oxner raides her right foot and quickly put it back down to catch her balance. Ms. Oxner tried again, counted to 4, then lost her balance. Ms. Oxner then stated that she could not perform the task. Sgt Jackson then asked Ms. Oxner to perform a heel to toe, In demonstration Ms. Oxner attempted to start the heel to toe portion of SFST. Sgt Jackson had to remind April Oxner not to start until told to do so. After Sgt Jackson completed demonstration, Ms Oxner attempted the heel to toe portion. Ms. Oxner took 5 steps, which she did not perform as shown, and stated she could not complete the task.
