Trump Faces Free Speech Battle Against Jack Smith

To preserve institutional integrity, Special Counsel Jack Smith wants a gag order for Donald Trump, arguing the President is undermining the investigation regarding a January 6 indictment. Trump faces four federal charges for his alleged attempt to overturn the 2020 presidential election results against President Joe Biden.
Fox News reports:
“Special counsel Jack Smith [has] requested a federal judge in Washington, D.C. to impose a narrowly tailored order restricting former President Donald Trump from making public statements that could present a serious and substantial danger of material prejudicing this case.
In a filing, Smith’s office accused Trump of engaging in a sweeping campaign of disinformation and harassment intended to intimidate prosecutors and undermine public confidence in the judicial system during his prosecution.
In service of his criminal conspiracies, through false public statements, the defendant sought to erode public faith in the administration of the election and intimidate individuals who refuted his lies, the filing said.”
So in other words, Smith wants to silence Trump and not allow him the chance to defend himself publicly, violating Trump’s First Amendment right to free speech – which Trump alluded to in responding to the gag order: “[T]hey want to take away my freedom.”
And the former President is right. Why shouldn’t the leading GOP nominee be allowed to criticize the Deep State pile-on that’s happening to him? He’s a public figure being denied the right to defend himself in the court of public opinion.
Add this gag order request to the 14th Amendment fiasco, as the far Left is unconstitutionally trying to deny Trump the right to be on primary ballots, and the pile-on is undeniable. The notion that an American citizen can be removed from a ballot without legal adjudication just because political opposition doesn’t like them is shameful.
We were in court today in Colorado fighting for all Americans to have the right to vote for the candidate of their choice. During our radio broadcast, we got the news that a judge granted us intervention status in our case, which is a big win for the ACLJ. We are now on an expedited schedule and could have a trial date soon.
