अधिवक्ता एवं महाधिवक्ता में क्या अन्तर है ?
[ What is difference between Advocate and Advocate General ?
उत्तर- अधिवक्ता वह व्यक्ति होता है जो न्यायालय में किसी अन्य व्यक्ति की ओर से पैरवी करता है , उसका पक्ष रखता है , उसकी ओर से उपस्थिति देता है और उसका प्रतिनिधित्व करता है ।
अधिवक्ता ऐसा कोई भी व्यक्ति हो सकता है जो विधि स्नातक है तथा जिसका नाम विधिज्ञ परिषद् की अधिवक्ताओं की नामावली में दर्ज है ।
जबकि संविधान के अनुच्छेद 165 के अन्तर्गत महाधिवक्ता ( Advocate General ) ऐसा व्यक्ति होता है जिसकी नियुक्ति राज्य के राज्यपाल द्वारा की जाती है । महाधिवक्ता के पद पर ऐसा व्यक्ति नियुक्त हो सकता है , जो उच्च न्यायालय का न्यायाधीश होने की पात्रता रखता हो । महाधिवक्ता राज्यपाल के प्रसादपर्यन्त कार्य करता है तथा उसे राजकोष से पारिश्रमिक मिलता है । महाधिवक्ता का कार्य राज्य को विधि सम्बन्धी मामलों में राय देना तथा राज्यपाल द्वारा समय - समय पर सौंपे गए कर्त्तव्यों का पालन करना है ।
