Stuttgart Arkansas PD Officer Hardin Bodycam DWI Traffic Stop August 10th 2023

On August 10, 2023 I, Patrolman Colton Hardin, was patrolling north on North Buerkle Street when I noticed a vehicle at the traffic light at West Michigan Street and North Buerkle Street had a defective headlight. The vehicle turned east onto West Michigan Street and I proceeded behind the vehicle. Dispatch was advised to run the license plate, Arkansas AGH78B, and a traffic stop was initiated. The vehicle turned south onto North Lowe Street then turned into the empty lot of the old Aaron's Rent to Own at 401 West Michigan Street. Contact was made with the driver, identified as Mrs. Janet Berry, and Berry was informed on why she was stopped. A strong odor of intoxicants was immediately detected coming from Berry. Berrys' eyes were also bloodshot and her speech was slurred. Berry was asked for her drivers license and she advised that she did not have one because it was suspended. Berry was asked her name and it was hard to understand what Berry was saying. After spelling her first name Berry was asked if she said Janeg, to which Berry replied yes. Berry was then asked to spell her last name and she advised Bry. After trying to run the name Janeg Bry through ACIC it was discovered her name was Janet Berry. It was confirmed that Berrys license was suspended for a previous DWI in 2020. Berry was asked if she had anything to drink and Berry replied no, then immediately said she wasn't going to lie and that she had a couple of beers. When asked how long ago Berry had the beers she advised an hour before hand. Berry was asked if she would be willing to take a breath test and Berry immediately became agitated. Multiple attempts with a portable breathalyzer test were made, with none successful. There were also multiple times Berry stated "I've been drinking." and even stated "I've been drinking my blank off." Berry was then asked if she would be willing to do standardized field sobriety tests and she agreed.

The first test administered was the horizontal gaze nystagmus test.
