The EB-5 visa, also known as the Employment-Based Fifth Preference visa, is a type of US visa for foreign investors who are looking to immigrate to the United States.
The program stimulates the US economy through job creation and capital investment by foreign investors.
To be eligible for an EB-5 visa, an individual must invest at least $1,050,000 in a new commercial enterprise in the US, or $800,000 in a high-unemployment or rural area known as a Targeted Employment Area.
The investment must create or preserve at least 10 full time jobs for US workers within two years of receiving permanent residency.
If these conditions are met, they and their immediate family members, spouse and unmarried children under 21 years of age, may be eligible to receive a permanent residency or green card.
As an alternative to starting or owning a business, the EB5 visa also provides the option of investing in a regional center project.
A regional center is a designated entity that is approved by the US Citizenship and Immigration Services to pool investment funds from multiple foreign investors to finance and manage economically driven projects.
Investing in a regional center project offers several benefits to the foreign investor, including the ability to make a passive investment, limited involvement in the day-to-day operations of the business, and the potential for job creation that meet the requirements for the EB5 visa.
Regional center projects often have a lower investment minimum and are more accessible to foreign investors who cannot meet the minimum investment requirement for a standalone business.
If an individual cannot meet the financial requirements of obtaining an EB5 visa, they might explore the option of an E2 visa instead.
The financial requirements for an E2 visa are less stringent than those for an EB5 visa, and the investment amount is typically lower.
This makes the E2 visa a more accessible option for those who cannot meet the financial requirements of the EB5 visa.
