Leo Donofrio Microspaces 1-2 on secret testing video, certification

Paraphrasing, Leo says the 'secret testing' video does not show any laws being broken and they're making the wrong case: ARS gives SoS Hobbs a wide latitude to interpret and apply the law in her EPM, and she did not specify *all* hardware, nor anything about software or system, in the county cert req's. He's also talked about a provision in EPM that allows them to make changes after cert. Leo says Lake should 59(a) motion for a new trial instead of 60(b) motion to reconsider, which is what she did (60b to reconsider).

Leo's had some hard arguments with these guys, mainly over the Williamson, TN (and all across GA) supposed QR Code error (https://electionoversight.substack.com/p/press-release-dominions-tennessee), where a ballot would trigger an error in the precinct tabulator and need to be rescanned, after which it would be accepted but, it turned out, not added to the actual count (on the closing tape), nor would any of the subsequent ballots be counted. Dominion's Root Cause Analysis report "states that when the anomaly occurs, it’s due to a misread of the QR code. If the QR code misread affects a certain part of the QR code, the ICP scanner mistakenly interprets a bit in the code that marks the ballot as provisional. Once that misread happens, the provisional flag is not properly reset after that ballot’s voting session. The result is that every ballot scanned and tabulated by the machine after that misread is marked as provisional and thus, not included in the tabulator’s close poll report totals."

Donofrio thought the same thing was happening in Maricopa with Real Time Provisionals RTP: ballots flagged RTP, re-scanned and counted on the display counter but not the memory card (printed to the closing tape). Apparently he was wrong, don't know exactly how but I read Maricopa has a different DS 5.5B configuration. Donofrio's theory however is VERY similar to the QR error->rescan->(accepted but not actually counted), although he didn't assert that every ballot coming after a RTP wasn't counted. Maricopa said in Jan. 2022 'Correcting the Record' report p.72 that RTP's are issued to EDB voters who received a mail-in they didn't vote. Indeed they appear to say, indirectly, that voters casting RTP aren't informed of this.

Leo says he's not taking Maricopa's side, but interpreting the law as he sees it written.

You can see in the filing that Lake's attorneys don't agree with Leo. Can they win? I think the judges are corrupt and they lose either way. Maybe their appeal grounds are more instructive for the public than Leo's and that's what the case is really about. It could also be about setting precedent for 2024.
