I am writing to ask you to support Matthew Hoover and Kristopher Ervin publicly. Two men who find themselves the victims of government overreach, weaponization, and injustice.
With troubling frequency, the Bureau of Alcohol, Tobacco, Firearms and Explosives, supported by the Department of Justice, has overstepped its bounds to redefine terms expressly defined by the Congress. This includes the redefinition of bump stocks to be considered machine guns, incomplete firearms to be considered completed firearms, and braced pistols to be considered short-barreled rifles.
American gun owners are subject to the whims of unelected bureaucrats to change the meaning of terms; contrary to Congress, contrary to plain meaning, and contrary to longstanding tradition. Unfortunately, the weaponization of these agencies and decisions made outside of the halls of Congress have real-world implications; they can and have destroyed lives.
The latest victims of this arbitrary and capricious method of “governing” are Matthew Hoover and Kristopher Ervin, who were just convicted in the United States District Court, Middle District of Florida, in connection to the alleged possession and transfer of what the ATF now considers an unregistered machine gun. In reality, the item alleged to be a machine gun was simply a metal card with a depiction on it, more closely related to a book, blueprint, or photograph, as opposed to a firearm or firearm part.
I am writing to encourage you and your fellow lawmakers to rein in the ATF and the DOJ for this clear First Amendment violation and unconstitutional override of Congress. These agencies have overstepped their bounds and need immediate oversight. Please support Matthew Hoover and Kristopher Ervin publicly and demand a hearing in the Select Subcommittee on the Weaponization of the Federal Government to get answers.
