The dispute, which Ryan Heath and Donofrio more-or-less take the same side of, is what grounds Lake should appeal Thompson's ruling on. Her lawyers went with the late/secret testing. Donofrio says there's a provision in Hobbs'/Ducey's EPM that allows for post-certification testing and further that the county level certification is hardware only, therefor Leo thinks they're making the wrong case. They should challenge Thompson's misapplication of the Miller standard.

I'll have some videos on Lake's argument in a few days. In my view they never adequately responded to Donofrio's criticism; but I think Thompson made up his mind before the trial started, and we'll see about the higher courts. The outcome appears to be predetermined, for better or worse this is a SHOW TRIAL.
