Could This Be a War Crime?

It looks like President Joe Biden has a very special gift for his friend and contemporary, Ukrainian President Volodymyr Zelenskyy, and Biden might not only be escalating the tension between the U.S. and Russia, but he might also be committing what his own administration has previously called a war crime in the process.
President Biden is planning to provide Ukraine with controversial cluster bombs, despite many of our allies agreeing to ban the deadly weapons because of the grave threat they present to civilians. Now Biden is drawing criticism for this potentially deadly decision.
Now the U.S. has not signed on to any bans on cluster bombs, and of course, neither has Russia. In fact, when asked about reports of Russian utilizing cluster bombs, former Biden spokesperson Jen Psaki said that the Administration had seen those reports, and if true, using the weapons would constitute a war crime.
But now her former boss, President Biden, is ready to ship them off to Ukraine to use in its defense against Russia. So why isn’t it a war crime now?
And on top of these cluster bombs, Biden is also reportedly sending F-16 fighter jets, as well as the Army’s tactical missile system, ATACMS, which they’ve reportedly refused to send until now because it would supposedly enable Ukraine to “fire deep into Russian territory if it rejected US admonitions against doing so.”
In other words, Biden isn’t just helping Ukraine defend itself anymore – he’s providing the weapons it needs to launch a counteroffensive, and that puts the U.S. in a very dangerous position. It’s certainly not going to improve relations with Russia, let alone a number of other adversarial nations.
As ACLJ Chief Counsel Jay Sekulow, explained, this could actually end up sabotaging potential peace talks, prolonging the war in Ukraine, and costing even more lives, including many civilians:
“This is absurd. . . . It was reported that there’s been settlement discussions, negotiations going on offline between the Russians and the Ukrainians, to try to get a resolution to this war. And it seems like every time they’re getting close to at least discussions, what happens is you have the Biden Administration upping the ante by now saying to the Ukrainians, “We’re going to now give you cluster bombs,” which previous Administrations have said was basically engaging in a war crime. So I don’t understand what the strategy is here and where this is going, other than people are dying every day in this conflict with no end in sight.”
Biden needs to be urging a peace plan, not providing more weapons to kill innocent civilians. Just as we saw with the botched withdrawal from Afghanistan, when President Biden gets involved with foreign war zones, he seems to only create more conflict, controversy, and destruction.
