ANDY WARHOL FOUNDATION LOSES COPYRIGHT FAIR USE ARGUMENT

In a landmark decision, the Supreme Court ruled that Andy Warhol's "Prince Series" was not covered under fair use in copyright law. The series, which featured various portraits of Prince, was deemed to be not transformative enough to qualify as a derivate work. The court considered all four fair use factors, including the purpose and character of the use, the nature of the copyrighted work, the amount and substantiality of the portion used, and the effect on the potential market for the original work.
