On February 13, 2021, former President Donald Trump was acquitted by the US Senate in his second impeachment trial. The indictment against Trump stemmed from the deadly January 6, 2021 Capitol riot, which was instigated by Trump's false claims of election fraud and his speech on that day, in which he urged his supporters to "fight like hell" to overturn the election results.

Despite the gravity of the charges against Trump, some legal experts, such as Alan Dershowitz, argued that the indictment was not very serious. Dershowitz, a prominent lawyer and Harvard Law School professor emeritus, served on Trump's defense team during his first impeachment trial in 2020.

According to Dershowitz, the impeachment indictment against Trump was unconstitutional because he was no longer in office at the time of his impeachment. He also argued that Trump's speech on January 6 was protected by the First Amendment, and that he did not incite the violence that occurred at the Capitol.

Dershowitz's arguments were not shared by all legal experts, and ultimately, the Senate voted 57-43 to convict Trump, falling short of the two-thirds majority required for conviction. However, Dershowitz's position reflects a broader debate over the seriousness of the charges against Trump and the merits of impeachment as a tool for holding presidents accountable for their actions.
