Mask Exemptions: The Official Govt Info

The exemptions in respect of ANY GOVERNMENT MANDATES are VERY WIDE.
So wide, it is hard to see how ANYONE in New Zealand could not legitimately qualify for an exemption. (And this is deliberate - the government knows the health risks of wearing mask.)
At the broadest the exemption covers:
👉 Any condition - physical or mental - that makes wearing a face covering unsuitable.
😷 However the issue that is arising this week is that (as inevitably given various directions by the powers that be) PRIVATE BUSINESSES are taking it upon themselves to insist that masks be worn and to refuse exemptions.
Any business trying to tell you they are enforcing government mandates by not allowing you enter without a mask when you confirm to them that you have an exemption is NOT enforcing a government mandate. Instead this business is prohibiting you from entering their business based on its own rules.
In doing so the owners of these businesses are assuming personal liability for discriminating against those without masks and are opening themselves up to significant liability in respect of serious negative repercussions for those persons prohibited from entry.

Many media and government websites are misleading in that are not making it clear to readers that exemptions DO exist.
Some of these exemptions are set out as specifically relevant to masks. Some of them apply more broadly to the entire Order.
You do not need to wear a mask if you have ANY condition - physical or mental - that makes wearing a face covering UNSUITABLE.
Also...
👉 You are not required to have medical certificate for your exemption.
👉 You are not required to get the "official exemption card".
👉 You are not required carry any paperwork/card with you.
👉 You are not required to state you have an exemption.
👉 You are not required to state the reasons for your exemption.
However, in practice you might choose to have a card and carry it and you might choose to say you have an exemption as unfortunately the majority of NZ public are deliberately not well educated on these points and being whipped into a frenzy to self police.
The government legislation provides wide exemptions (and for good reason - the government is motivated not to be legally on the hook for having legal claims via ACC since mask wearing has the potential to cause serious adverse health events). Instead the modus operandi is for the private sector to conveniently play the police in these matters.

The Complaints Board agreed the likely consumer takeout of the advertisement was: in the Advertiser’s view, masks aren’t as good as we’ve been told. This is because they’re ineffective and cause pollution. Consumers can also seek exemptions from wearing them.
Were any of the statements in the leaflet misleading?
The Complaints Board agreed that none of the six statements made in the advertisement were misleading, because they had been adequately substantiated in the context of advocacy advertising.
