BREAKING Duty to Retreat Law Gets VICTIM arrested? Took Gun from Attacker! New York Case Happening!

Ex-state criminal prosecutor Tom Grieve explains the confusing mix of facts and law as the dust continues to settle in the New York self-defense shooting case of Mr. Moussa Diarra.

The facts are fuzzy and are subject to change because this is early reporting and analysis. Right now it appears that on April 2, 2023 at 5:30am, parking lot attendant, 57 year old Mr. Moussa Diarra saw a man peering into car windows in the parking garage where he worked just near Madison Square Garden at 340 W. 31st street. Mr. Diarra approached the suspicious man and asked him what was in the bag that he was carrying. If you are new to crime, then allow me to inform you that burglars who are looking to break into cars often carry a bag or backpack with some basic tools to make vehicle entry as well as to hold their loot. It appears that as Mr. Diarra approached the man, the possible burglar suddenly pulls out a gun from the bag and appears to have shot Mr. Diarra twice, once grazing his ear and the second time straight to his stomach. It is unclear at this time whether Mr. Diarra was grabbing for the gun at the time that he was shot. Mr. Diarra successfully wrestled the firearm away from his assailant and shot him once in the chest, ending the encounter. Both men were transported to a local hospital where they are reported to be in stable condition.
