OVERVIEW OF UDRP DOMAIN DISPUTES - PART 2

The WIPO Arbitration and Mediation Center administers the Uniform Domain Name Dispute Resolution Policy (UDRP) for domain name registrars. The UDRP is a process by which trademark holders can seek to resolve disputes over domain names that are identical or confusingly similar to their trademarks.

There are four key steps in the UDRP process: filing a complaint, filing a response, WIPO conducting an administrative proceeding, and WIPO issuing a decision.

1. Filing a Complaint: The complainant must submit a complaint to WIPO, along with the required filing fee. The complaint must include (1) the domain name in dispute; (2) the complainant's trademark or other rights in that domain name; and (3) an allegation of bad faith registration and use of the domain name.

2. Filing a Response: The respondent has 20 days to file a response to the complaint. The response must include (1) the domain name in dispute; (2) the respondent's trademark or other rights in that domain name; and (3) an allegation of bad faith registration and use of the domain name.

3. WIPO Conducting an Administrative Proceeding: After WIPO receives both the complaint and the response, it will appoint one or more independent panelists to decide the case. The panelists will review the arguments and evidence submitted by both parties and render a decision within 14 days.

4. WIPO Issuing a Decision: Once WIPO has received the panelists' decision, it will notify both parties of the outcome and publish the decision on its website. If the panel decides in favor of the complainant, WIPO will direct the registrar to transfer the disputed domain name to the complainant. Alternatively, if the panel decides in favor of the respondent, WIPO will take no action and the disputed domain name will remain with the respondent. either party can file an appeal with a court under either the ACPA or UDRP rules.
