Motion to Quash leads to voluntary dismissal in Malibu Media case

In this case and "Doe" Defendant fought back when charged with illegally downloading 131 adult pornographic movies, and filed an F.R.C.P. Rule 45 Motion to Quash Subpoena.

Judge Alsup issued a final order to "stay" enforcement of the subpoena, meaning the Plaintiff could not get the "Doe" IP address information from the ISP (Comcast), The thrust of the decision had to do with the failure to provide a declaration from the investigation company that tracked the illegal downloading and failure to provide a first-hand declaration or affidavit that would convince the judge that there is sufficient "reliability" to the geo-location tracking technology that would ensure the court the defendant resides in the district and supporting that the court would have proper jurisdiction.

The case ended with a "voluntary dismissal" showing that this could be one important tool in the torrent defense lawyers' toolbox.
