General legal overview discussing the issue of when, and under what circumstances, can you cite an UNPUBLISHED case to a either a federal court or state court in California, to cite it as legal precedent or persuasive authority?

This is part one of a two part video series.

In California, there are State Courts of Appeal and Appellate divisions of Superior Courts that issue legal opinions all the time. However, only about 10% of these are ever "published" or "certified for publication." As such, they cannot always be cited and there are rules as to when and how they can be cited. This video helps explain when you can and cannot cite a case.

Federal Courts have both district courts and federal courts of appeal. There are also rules in what courts will consider as persuasive authority in these courts as well.

In general, the California Supreme Court as well as the United States Supreme Court publish all decisions and these decisions can be cited as legal authority in your briefs and motions. --------------------------------------------------------------------------------------------------------------------------------
