WHAT IS EMINENT DOMAIN?

Eminent domain grants the government the right to take possession of an individual's real estate for public purpose, while providing just compensation. This can be incredibly upsetting and intrusive in people's lives when they need to relocate quickly and involuntarily due to their property being seized. However, the government must adhere strictly to the principle of just compensation; if not met, individuals have the right to contest their proper compensation through legal means. In this way, a fair solution is arrived at that honours due process & does not unduly harm either party in the dispute.

This affirmative defense deals with A.R.S. 12-1115 (failure to balance the least private injury vs. the greatest public good). To prove this the property owner must first raise the defense in answer, demurrer or at the OIP hearing (at the earliest possible instance) and the land owner bears the burden of proof to show the violation of the eminent domain statute by "clear and convincing evidence."
