OVERVIEW OF INNOCENT INFRINGEMENT IN COPYRIGHT LAW. THIS IS NOT A DEFENSE PER SE, BUT RATHER A DAMAGE MITIGATOR.

In this episode of Litigation Whiteboard® Attorney Steve® explains how to RAISE and PROVE innocent infringement when you are a defendant dealing with allegations of photo infringement, software piracy, and illegal file-sharing of movies like Strike 3 Holdings, and Malibu Media and infringement of other copyright-protected digital content.

When it comes to software, copyright law is complex. Even if you didn't know you were violating the copyright law, you may be held liable. However, there is a defense called innocent infringement. If you can show that you were unaware that you were infringing on someone's copyright and that you took reasonable steps to prevent infringement, then a court may find you not guilty. This is often seen as a mitigating factor in cases of software piracy. For example, if you unknowingly download a file-sharing movie or photo, you may be able to raise the defense of innocent infringement. However, if you continue to share the copyrighted material after being warned not to, then the court is less likely to find it in your favor. Innocent infringement is just one factor to consider when facing accusations of copyright infringement. But if used correctly, it can help to reduce your liability.
