Can a sitting President be sued in a civil court lawsuit?

In this episode of Litigation Warrior Attorney Steve discuses whether or not a private Plaintiff can sue the President of the United States.

In short, the answer is YES. In a recent civil case in Los Angeles, California the current president, Donald Trump, was sued by Stormy Daniels (who was in the adult porn business) and she seeks to get out of her non-disclosure agreement and rumors have said she is willing to give back the $130,000 she allegedly received from The Law firm for Essential Consultants, LLC (Defendant) seeks to remove the case to the Central District of California (federal court). Then, their strategy might be to try to remove the case to PRIVATE ARBITRATION where the case can be heard. It is also possible he might seek some type of presidential immunity but there is case law (Paula Jones v Clinton) that allowed the then sitting President Bill Clinton to be sued for his non-official acts (not related to his Presidential duties).

So, I expect the court will allow removal on the diversity basis, and if the contract (NDA) was freely entered into I expect the Court will order a private arbitration. A "gag order" may also be sought.

All Defendants are presumed innocent. Note that Donald Trump has denied that he knew anything about the settlement and there is a question over whether or not he actually signed the NDA. --------------------------------------------------------------------------------------------------------------------------------
