Google Subpoena and the "Notice to Consumer"

In this video Attorney Steve® discusses the deposition subpoena to Google seeking an email address, IP addresses, metadata and/or other information.

What should you do when you get a notice to "consumer or employee" relating to a party to litigation seeking to obtain your private information? The best thing is to "lawyer up" and find out what your legal rights and remedies and responses might be.

For example:

1. You may be able to contact the lawyer or law firm that issued the subpoena and try to get them to drop it

2. You can see if they will limit their search to emails (or text messages if dealing with that) to digital content containing certain keywords such as ones with litigant/party names in the header or subject line of the email.

3. If you are a party to a litigation you may want to consider sending over a meet and confer letter and proposing a "first look" solution whereby the subpoenad documents are sent to counsel and reviewed to withhold from producing privileged or private documents. The withheld documents are maintained on a privilege log and provided to the attorney sending the subpoena. They can decide if they want to object from here.

or seek a "protective order"

5. In some cases the party seeking emails, videos, or text messages may agree to a protective order (stipulate) or confidentiality agreement agreeing only to use the documents they obtain for "litigation purposes only."
