TORRENT LAW DEFENSE - INADEQUATE PLEADING - COBBLER NEVADA CASE

Attorney Steve® discusses the Cobler Nevada case. This case from the United States Court of Appeal 9th Circuit holds that a Plaintiff copyright holder cannot allege direct copyright infringement merely by alleging that a internet subscriber is the subscriber of the account that was used to engage in illegal file sharing.

Moreover, it is not enough to merely name the subscriber as a contributory infringer where there are no FACTS to support aiding, abetting, encouraging or facilitating infringement. The pleading must allege something more than a failure to respond to copyright infringement notices or a failure to "police" the network (in this case an unsecured wifi in a foster care home).

This is a good case that was cited for "publication" and which might come in handy as persuasive law in your jurisdiction. In particular, with regard to Malibu Media and Strike Three Holdings, LLC cases where you may find insufficient allegations of infringement being made.
