When Judges Help Disarm Their Citizens

Washington Gun Law President, William Kirk, discusses the recent rulings in the matter of Bevis v. City of Naperville, yet another challenge to Illinois' recent assault weapons ban. This time, however, the presiding judge created a whole new rule of law, a new "common use test" to justify the Illinois ban. Believing that these sorts of regulations have been historically permitted for any weapon which is "dangerous" the Judge here has taken a page from Justice Thomas and carved out a new one part "common use test."
