- The 1993 CWC treats tear gas as a "Riot Control" agent, or RCA
- The 1993 CWC prohibits using RCA "as a method of warfare", but doesn't define "method of warfare"
- The US Senate ratified the CWC in 1997, but basically said "we don't think it applies to RCA"
...literally "the President shall certify to Congress that the United States is not restricted by the Convention in its use of riot control agents"
- United States has EO 11850: RCA CAN be used "in war", but "in defensive military modes to save lives" when approved in-advance.
