Man Charged with OVI After Backing into a Patron's Car While Leaving a Bar
CHILLICOTHE, OH - At 7:04PM on January 6th, 2020, Chillicothe police received a call regarding a car accident outside a local bar. Police interviewing the man whose car was hit claimed that he had to stand in front of the suspect's vehicle who backed into him to prevent the driver from fleeing. After the police verified that the damage on the caller's vehicle contrasted with the suspect's side of the story, the officer isolated the suspect from the situation. Miranda rights were read to the suspect as soon as he was separated from the scene of the accident.
A field sobriety test was initiated shortly after interviewing the suspect who stated that he had planned to drive away because all he had heard was, "a little bit of a tap," and that the other patron's vehicle was not in his parking space. The horizontal gaze nystagmus test showed that the suspect was unable to smoothly follow the officer's pen and consistently moved his head for the duration of the test even though he was instructed to follow the object with his eyes only. During the walk-and-turn test, the suspect did not follow instructions given to by the officer. The suspect was unable to walk in a straight line and also failed to touch heel-to-toes with each step as per the officer's instructions. The suspect was unable to balance while performing the one-legged stand test for any period of time.
Following the field sobriety test, the suspect was arrested for operating a vehicle under the influence (OVI) and for improper backing whereupon arrangements were made to tow the suspect's vehicle. The suspect eventually pled guilty to OVI and was charged a total of $711 between fines and court fees, senteced to 1 day in jail (credited from spending the night in jail after his arrest), and had to enroll in a driver intervention program. The result of the suspect's chemical urine test was .242 g alcohol/mL. That is three times the legal limit to drive in the State of Ohio (.08 g alcohol/mL).
