Florida law stipulates that all riders under the age of 21 must wear a helmet while operating or riding a motorcycle. Only the following individuals are eligible for the motorcycle helmet exemption:
- 21 years of age or older and
- covered by an insurance policy providing at least $10,000 in medical benefits.

Remember, to meet the $10,000 insurance exception, medical insurance must provide benefits specifically for motorcycle crashes. Florida doesn’t require motorcycle insurance, and your Florida PIP vehicle coverage doesn’t automatically cover your motorcycle. Be sure you have a policy that specifically covers the use of your motorcycle.

What Is the Penalty for Operating a Motorcycle Without a Helmet in Florida? Operating a motorcycle without a helmet in Florida is a non-criminal, non-moving violation. The operator receives a ticket and pays a fine.
