Is ATF Losing Control of Unfinished Frames and Receivers?

Washington Gun Law President, William Kirk, discusses the ongoing litigation in the matter of VanDerStok v. Garland which is a challenge, in the Northern District of Texas, to ATF's new rules on unfinished frames and receivers. This suit alleges that ATF has overstepped its boundaries by now regulated raw pieces of material where Congress has only authorized ATF to regulate firearms. "Firearms" is a specific term, defined by Congress, and that is the only area of firearms that ATF has jurisdiction over. Why then are they now allowed to regulate raw material?

It was encouraging that the trial court had granted the preliminary injunction but recent developments shed an even more positive light on this lawsuit. A manufacturer of 80% lowers, a named plaintiff in this lawsuit, has asked for additional injunctive relief to allow them to continue to do business as if the rule was not even in effect.
