Polk deputy gets shot in chest (bulletproof vest), still takes suspect down

The Polk County Sheriff's Office on Monday released surveillance video of an incident where a suspect shot one of its deputies.

Deputies say they were called to the area in Davenport last Wednesday because of a domestic disturbance.

They say that's where they were confronted by 41-year-old Gabriel Batista. When they arrived on the scene, they learned Batista had been harassing and threatening his wife.

Video shows him walk around a van with his hands behind his back.

As deputies approach, they try to Taze Batista, saying that's when he fires six times at one of those deputies.

That deputy was struck once in the chest and was saved by his bulletproof vest.

He was actually able to still fire a shot at Batista that missed.

Deputies say Batista surrendered and was arrested.

"That vest clearly and unequivocally saved his life. That was a dead-center shot into his heart, and I believe St. Michaels and the good Lord had a lot to do with it because those other five rounds missed," Polk County Sheriff Grady Judd said.

According to the sheriff, Batista told his family he wanted the deputies to shoot and kill him.
