"That's not the end of my concerns. I have very, very strong reservations about the wisdom of conducting this audit. As a couple of the speakers noted, we are in active litigation regarding the secretary of state's race. Therefore you all cannot audit those ballots. We are defendants in that action. You cannot audit those ballots.

Now, Mr. Dvorak also requested that you audit the governor's race. As we have discussed, and again, a number of people have done their research and understand there is no law. The law is silent about post certification audits. That means there's significant risk here. Okay, because there's no guidance, we don't know how you do it if you do it right or if you don't do it right. And the secretary of state's office and the state election board have tremendous power over this body, they have the power not only to, excuse me,(raps ruler on desk twice*) they have the power, not only to find this body $5,000 per violation. So that could mean $5,000 per ballot, audited, which if you're ballot auditing 25,000 ballots, what is that 200? I don't even know. More importantly than a fine, SB. 2 0 2, which was passed last year provides for the takeover of this board by the secretary of state's office and the state election board . So if they find that you all have committed too many violations within too short a period, you all could be gone and the secretary of state's office and the state election board could put a single person in to run the elections in Cherokee County. So when I look at those kinds of risks, I ask myself, how can you conduct an audit, which will not expose you to these risks? The answer I come up with is, ‘well conduct the same audit you conducted in July,'"
