Today (29 August 2022) I had my day in court and fought the 55 dollar loading zone fine from 18/09/2021. Miraculously there was no mention of the $431 fine Snr Cnst. Haworth also gave me simultaneously that day despite his Witness Statement saying he only issued one 'Infringement notice".

On the morning of the Freedom Rally I drove around 4 or 5 times to try and unload Bins, staging equipment, food, BBQs, Drinks and the like. Police and Council were telling us they would open the Lower Botanic Garden Gates but no one ever did. I am sure someone was having a good ole laugh. On the 4th or 5th return to the top of the Gardens/Speaker's Corner loop, Police stopped me and blocked traffic until a Highway Patrol car Sargent came and made her decision. This inconvenienced many people for about 30 minutes. This 'fine' matter is still waiting for a trial in October 2022.

Strangely I already got a $330 fine in the morning for having a trailer plate they deemed illegal. They then removed the plate. Later Snr Constable Haworth gave me a fine for not having a trailer plate on in addition to the $55 overstaying a loading zone fine. That $431 dollar fine was never posted to me nor the $55 fine. Earlier this year, thankfully a text message from the Magistrates' Courts alerted me to that court case in March and from there we arrived at this hearing in August. At the initial mention I noted in the QP9 - Statement of Facts that they claimed I had been registered posted the details. This was not the case. I raised this with the magistrate and they said they would rectify it.

Sadly for the Prosecution, Constable Haworth's claim that they had registered posted the fines to me from Redhill Post Office in person did not match up with the printed name on the "Receipt" which stated CWebb.

On cross examination, Constable Haworth could not explain where my signature was to prove it had been received. He just said nothing was returned to him so I must have gotten it.

A submission for "No case to Answer" where, "as the evidence stands I could not be convicted" won the day.

The female Magistrate I had today was excellent and a reminder that the "system' is not totally stacked & fully broken and there are still fair and just people in there. As a mate said, They are just people too with their own problems, family, experiences, hopes & dreams.

The prosecutor was a Senior Sargent doing what she said was a job two ranks below her at Senior Constable. During the recess both her and the TMR Prosecutor (The one I will likely be facing in October 2022) turned nasty to me. The Senior Sargent said "I don't drive unregistered vehicles and park where I shouldn't". I corrected her that neither of these two statements were correct and told her this was a false allegation. She went on to say that she was accountable for her actions and I asked her if she would be happy to stand by those claims. She then stated that it was her opinion and that we all have different opinions She told me I should tell the magistrate what she said. Not wanting to let her down, when the Magistrate re-entered from recess, I did exactly that.

The male The Mains Road Prosecutor whom was sitting in presumably to get the jump on the Oct Case was very combative and denied they got things wrong. I mentioned to him that they got the Date of Trailer rego wrong, the Type of trailer wrong, the Trailer Rego wrong & the street wrong. They actually have a submission prepared to correct all their errors from the initial filing. It is quite saddening to know that such hatred exists from these organisations to normal citizens. Is it the money, the power the "them and us" , they type of people 'prosecutions' attracts?

At any rate, I have been telling people to fight injustice and fines for years and like to put my actions where my mouth is and lead by example. I am sure I will suffer many defeats soon before I am done but I just wanted to share this with you all in the hope that it brings some uplifting energy, gives some pointers and adds to the Our Freedom Library of Alexandria in a helpful way.
