'Irresponsible Riding Causing A Crash' Turn 9 Analysis @PacificRaceways | Irnieracing

I traveled to Pacific Raceways for my safe warm-up race weekend after taking two months off to heal my broken right thumb, disabiled in a race crash July 13, 2019 at Mission Raceway. I fixed my broken BMW two days before loading up for my #LorenzoComeback with the WMRRA September 6-7, 2019. Unfortunately a fellow competitor had other ideas, and made a very dangerous pass attempt on the last lap, riding with his crash or pass mentality.
He punted me from behind, when I was travelling exactly 165kmph, putting his right handlebar into my back left shoulder blade, crashing himself out, and nearly sending me through the fence. What's worse is the CBR1000RR M. Pierce gave me no apology and later states i'm to blame for the rider contact. The WMRRA rule book clearly states the responsibility for safe passing lies with the passing rider. It is also the duty of all riders not to make wild and erratic changes in direction in such a way as to endanger passing riders who may be committed to a fast line and have insufficient room to maneuver.

I acknowledge the lead rider’s responsibility not to make wild and erratic changes of direction which would endanger a passing rider. To assist your consideration of this incident, I compiled this video with several angles, and also including slow-motion replays. The video starts with multiple video shots of exiting turn 7 to turn 9 entry, demonstrating a consistent, predictable line every lap.

As the footage clearly shows, at no time before or during the incident did I make any wild or erratic changes of direction. I choose my line, committed to it, made no erratic changes of direction, and was collided with from behind by Mitchell’s motorcycle.

Mitchell’s apparent lack of understanding about fault for the incident leads to concern about future unsafe incidents on track. His Facebook posts clearly insinuate that he is willing to do dangerous and illegal moves in the future. Such comments and on track actions by Mitchell may also breach Section K – Rule 3 of the WMRRA Rulebook which reads as follows:
3. Unsportsmanlike or unsafe conduct by any competitor, official, pit crew member or spectator is absolutely prohibited. The penalty for unsportsmanlike conduct by any of the above will result in disqualification, forfeiture of any awards or prizes, suspension or ejection from the racetrack premises at the discretion of the Referee. Appeals of decisions regarding unsportsmanlike conduct must follow the procedure outlined in section A-1 and bylaws Article 5. 

I would suggest that taunting or intimidating another rider with the prospect of dangerous passes in the future could be seen as unsportsmanlike conduct under the rulebook.
I refer this incident to you with the hope that future WMRRA races are contested in a fair, legal and safe manner. The severity of the incident, and the injuries that resulted from it warrant your consideration and possibly disciplinary action.
