How Can I Achieve Best Outcome At Sentencing? TOP 3 TIPS

We all hope and pray for an extremely favorable sentencing outcome such as probation or the possibility of home confinement. The reality is that does not happen often for the majority of federal defendants. What steps can a federal defendant take in order to create the best possible outcome at federal sentencing? It starts with first creating goals of an outcome you ultimately want.

The goal in play here is clearly a desired positive outcome. Keeping that goal in mind it’s now time to create the game plan of steps required to achieve said goal.

Step 1) It is extremely important to fully understand the importance and dynamics of a presentence report as to when this takes place and what it's contents are designed for. Being prepared for the day of the PSR interview process with U.S. probation should be well thought out as to what you are going to say, what you are going to bring, and what you hope to achieve during this interview.

Step 2) Creating the letters which will be used to illustrate who you were prior, who you are now, and what journey you took to arrive here. Your personal narrative is an opportunity to stand out from your past through an explanation of topics that gives the reader in this case the judge a view from your perspective. The question you need to keep asking yourself is what differentiations from what others before me have said to a judge in order to achieve a lenient sentence? How can I be perceived differently? Step 3) Once you are sentenced is a great time to ask for a specific date to surrender as well as a desired location within the BOP. Asking for a specific date of self-surrender which is typically 30-90 days should be based on valid reasoning such as family, closing a business, medical needs, and so on. This will also give you the time to allow the BOP to designate you so that you can surrender to the actual prison versus the U.S. marshal. Asking for a ridiculous amount of time to self-surrender will likely backfire as well as upsetting the judge and work against you. You must remain realistic. When asking the judge to recommend a specific location within the BOP it is important to have a good idea of what prisons you are eligible for based on custody level and program needs such as RDAP. Keep in mind that a judge's recommendation is not a guarantee of where you will go. The final decision of designation is up to the BOP.
