A Bridgeton police officer faces criminal charges after he allegedly used pepper spray without provocation on a handcuffed man.

Officer John Grier III also is accused of falsifying a police report about the incident at a Bridgeton gas station in June 2017.

An indictment says Grier acted "without cause" when he twice used pepper spray against a motorist who'd just been arrested for suspected drunken driving.

It alleges Grier falsely claimed the driver had resisted arrest and that the first use of pepper spray had no immediate effect.

The indictment notes Bridgeton officers are equipped with two containers of pepper spray. A small canister, attached to an officer's duty belt, is intended for use against individuals. A large can, stored in patrol vehicles, is intended for crowd control.

It says Grier used a large container against the driver, identified in a police report as Marty Drummond of Salem City.

According to the indictment, Grier responded as a backup officer to a report of two men creating a disturbance at a gas station.

During an initial stop at the station, Grier held a small container of pepper spray and directed Drummond to return to his car or be sprayed, the indictment says. Drummond returned to his vehicle.

The indictment says Grier then left the gas station, but returned when officers at the scene reported Drummond and his passenger were being belligerent.

When Grier came back, the indictment says, the officer "got out of his patrol vehicle holding a large can of (pepper) spray."

The indictment says Grier asked Drummond, "Do you want to feel pain, sir?" and held the can of pepper spray at arm's length and pointed toward the driver's face.
