"Only a Yes is a Yes" in Spain : legislators are toughening the anti-rape legislation || Sexuality
It is a significant step forward, and the Spanish government has made a commitment.
A law on sexual freedom to improve the fight against rape was approved by an absolute majority of the deputies.
In the perspective of the law, any sexual conduct not consented to in a clear and free manner will now be considered rape.
The only thing that will be required is explicit consent.
The bill now moves to the Senate for consideration.
Until now, the victim had to prove that she refused and opposed the sexual contact in order for justice to be served.
The "only yes is yes" law, which refers to express permission in sexual interactions, is a legislative project of the Ministry of Equality, which is managed by Podemos' Irene Montero, a socialist minister.
So, regardless of whether there is violence or intimidation, any sexual intercourse without consent is an assault.
During the debate in Congress, Minister Montero stated, "Sexual freedom will finally be a right in our country, and we will replace violence with freedom, and fear with desire."
Despite the "reactionary cacophony" from the far right, aggressors, and "patriarchal justice," she cautioned that women's sexual liberation will become a reality.

The Popular Party's conservative Marta González believes that this is not the right law against sexual violence because it "looks like a slogan of an electoral program" of Podemos.
