The ACLU helped write Amber Heard's WaPo op-ed that is central to Johnny Depp's defamation suit, after being promised donations from the proceeds of her divorce. What is going on here?
In essence, the case has revealed that the ACLU wrote the OP-Ed pretending to be Heard in exchange for a donation, explicitly timed to coincide with the release of an Aquaman film to drum up public attention for the premiere and/or to benefit from it. To quote another article:
The ACLU also claims it was charged with pitching the op-ed to a number of outlets, with the organization originally considering the likes of Teen Vogue and The New York Times, before settling on The Washington Post. Gerry Johnson, another ACLU associate, can be seen discussing the opportunity to release the op-ed just before the release of Aquaman, in a bid to drum up press around Heard before the premiere.“Since draft turned out pretty strong and Aquaman slated to do large numbers I’m wondering what you think about it?” he wrote in an email thread. Another staffer is then alleged to have agreed that the timing of the op-ed should be published as quickly as possible, “to capitalize on the tremendous campaign for Aquaman.” The news might have implications for the ongoing legal dispute between Depp and Heard (a defamation case over that piece ruining Depp's reputation and professional career, alleging he was abusive, while he has presented evidence he argues that it was actually Heard who was emotionally and physically abusive) as correspondences show that the piece originally explicitly named Depp (the final version is vague, hence the dispute over if it is defamation)...

..But I am more interested in (and the Mods want the comments on this post to focus on, per my conversations with them clearing this post in advance) hearing legal professionals or others who are interested in law or who might have experience with Civil Liberty organizations chime in to comment on the ACLU's involvement.

The fact that: They decided to get involved when it is not a state or federal case involving civil liberties. They did so at least partially in exchange for a monetary donation from Heard. They ghost-wrote an article that was presented as coming from Heard herself. They timed it to coincide with a major movie release Heard had a vested interest in the success off Seems pretty eyebrow-raising to me. Are there ethical issues here? How common is it for the ACLU or other groups to involve themselves in a he-said-she-said dispute between two private parties, or to ghostwrite articles? What do you think the impact this will have on the ACLU's place in the legal landscape if anything.
