Harless, 47, found himself at the center of a media firestorm in 2011 when video surfaced of him threatening and berating a motorist after learning the man had a permit to carry a concealed weapon. The city fired Harless in 2012 after discovering that he made similar threats during two previous traffic stops.

As part of the settlement reached this week, the city has dropped its appeal of an arbitrator’s ruling that cleared the way for Harless to return to work pending medical clearance. Harless, too, will drop all claims, including a lawsuit that the city retaliated against him for applying for workers’ compensation and a grievance involving vacation and sick leave.

Kristen Bates Aylward, deputy chief counsel for the Canton Law Department, declined comment. Michael Piotrowski, attorney for Harless, could not be reached for comment. Both sides also agreed that they will not publicly comment on the case.

During the June 2011 traffic stop, Harless became enraged when he discovered that William Bartlett of Brewster was carrying a loaded .38-caliber pistol.

Bartlett was behind the wheel of a vehicle stopped in the road in the 100 block of Newton Avenue NW. When Harless and his partner arrived, a woman known to be a prostitute exited the car, police said. A man suspected of being her pimp stayed in the vehicle with Bartlett.

Bartlett had a concealed-carry permit but did not immediately notify Harless that he was in possession of the gun, police said. Bartlett has argued to the contrary.

Harless screamed profanities at Bartlett and told him he wouldn’t lose any sleep if he would have shot and killed him.

The video taken from police cruiser camera went viral after it was posted on the Internet by Ohioans for Concealed Carry. Bartlett reported Harless to Internal Affairs, which discovered that he made similar threats during two previous traffic stops. He was fired in January 2012.

Bartlett could not be reached for comment Wednesday.

A year ago, an arbitrator ruled the city did not have sufficient grounds to fire Harless and that he should be reinstated if cleared by medical professionals. Harless had been on medical leave since shortly after the confrontation with Bartlett. He filed for workers’ compensation after being diagnosed with post-traumatic stress disorder, which stemmed from a Jan. 1, 2003 incident.

The settlement notes that Harless still had not been cleared to return to work.

Harless agreed to resign in writing, effective the same date that city fired him. He can’t apply for another job with the city. All requests by future employers about Harless’ employment record must be answer in writing and include only factual information, like dates of employment and the positions he held.

“Mr. Harless understands that the public records that have been created regarding the Internal Affairs investigations and his subsequent discipline cannot be destroyed at this time and must be produced upon a valid public records request,” the settlement says.
