As the result, more than 230 gallons of oil spilled into the basement of the Demers family home as well as more than 50 gallons of oil spilling out of the vents, down the foundation wall, and seeped into the ground on the Demers property. ACADIA Insurance Company of Bedford, NH, hired environmental contractors to remediate the site and their senior claims adjuster, Leo Perreault handled the claim and monitored their activities. Acadia spent over $400,00.00 to remediate the oil spill to a minimal New Hampshire State remediation standard. This was more than the value of the home and property. The New Hampshire Eagle Tribune September 30, 2011 Family waits for trial over fuel contamination Eagle Tribune reported the following: “In 2008, the property was assessed at more than $330,000, but has dropped to $191,300, according to Vision Appraisal Services. The home is only assessed at $55,000." Eagle Tribune reported the following: But a representative from Ambrose Environmental Management Inc. said the time line for residential spills varies site by site. “This one’s had a wrinkle,” said Tom Wigglesworth, a field services representative for Ambrose, before declining to comment further. Another representative from Ambrose reached by phone would not comment. Union Leader reported the following: Tom Wigglesworth, the supervisor in charge at Ambrose Environmental Management, said a vapor extraction and the wall removal are options still being considered for the cleanup's “final polish.” “We are hoping (the cleanup is resolved) relatively shortly, and I don't know what “shortly” means, but we're all working for the same goal,” Wigglesworth said. Union Leader reported the following: Tom Wigglesworth, site supervisor for Ambrose Environmental Management, declined to comment on the lengthy cleanup and progress at the site. “This whole thing has turned into a bit of a hot potato,” Wigglesworth said. Tom Wigglesworth was the site supervisor for Ambrose. Cliff Ambrose is the president of the company. ENPRO Services, Inc. of Salisbury, MA, conducted the fourteen-month remediation of the oil spill for Acadia. Dr. Geoffrey Brown was the environmental scientist in charge of the cleanup. Enpro environmental personnel were at the home one hundred and thirty-five times over a fourteen-month period. They failed nine consecutive indoor air tests which led to the largest discovery of contamination on the property nearly one year later. There were more environmental trucks on the property one year and two days after the oil spill than the day of the oil spill. A New Hampshire State soil remediation standard means that there are chemical compounds that are found in fuel oil that are left in the soil that meets the so-called NHDES State remediation standards. An oil spill is considered to be an "Emergency Response" situation. The property is on a protected wetland and a stream runs approximately 30 feet behind the home. The lengthy remediation of the oil spill allowed the oil spread and to enter the groundwater table below and alongside the home. At the bottom of page click on ☞FULL SITE INVESTIGATION REPORT Prepared on April 24th, 2008. This cleanup of the oil spill at Mrs. Demers’ home lasted over fourteen months. While the homeowner Mrs. Demers and family members were forced to immediately leave their home with a handful of clothes, their 3 pet cats and check in to a hotel. We believe after speaking with state environmental experts and others that generally a spill of this size (an estimated 250-270 gallons) This remediation of the oil spill at Mr. Demers’ home should have taken no more than 2 - 3 months to complete. Acadia Insurance, Senior Claims Adjuster, Leo Perreault monitored the remediation of the oil spill at Mrs. Demers’ home. He visited this home several weeks after the oil spill on March 5, 2007.Although, Mr. Perreault was not obligated to do so and his job was to monitor the environmental contractors’ activities. He did visit the home as a courtesy, to inspect furniture and home including the finished basement after he got a call from his environmental manager Tom Wigglesworth and allegedly Mr. Demers. Wigglesworth thought the furniture and home did not smell and when Mr. Perreault came to the home and he thought the home and furniture was fine. The Demers’ reported to their homeowner’s insurance company and Acadia’s environmental manager Mr. Wigglesworth from AMBROSE and NHDES about strong fuel odors in the home and odors in furniture at the time and Mrs. Demers days before had an expert from Ace Upholstery Company of Salem, NH, come in to examine the furniture and he determined it would need to be reupholstered. On February 28, 2007 several days before Mr. Perreault's visit to the home Acadia's environmental manager had told the Demers' and the New Hampshire Department of Environmental Services (NHDES) that the cleanup was complete, and the only thing left was a final cleaning of the home. On March 21, 2007: The Salem Health Inspector came to the home and reported Strong Fuel Odors in the Home. Watch video click You Tube link: https://youtu.be/bFdU2B-G4gA The Demers’ were not satisfied after the fourteen-month remediation of the oil spill, at their family home was completed, to a minimal NH state remediation standard level and for many reasons. Here are just a few reasons. The Demers’ allege that they were told they would be put back in the same position. While the Haffner’s insurance representative and environmental manager deny this was said. Mrs. Demers never received any written document initially or at any time from Haffner’s or Acadia that states they would remediate the oil spill to a NHDES state standard remediation level. Mrs. Demers never agreed in writing or verbally to a minimal New Hampshire State remediation standard cleanup. This oil spill was a hundred percent covered loss under Haffner's insurance policy with Acadia. The policy limit for this loss included coverage of 1,000,000.00 with a 5,000,000.00 umbrella. The claim number from Acadia was Claim No 20053028. The Demers' felt the fourteen-month oil spill cleanup was unacceptable. Regardless of whether the New Hampshire Department of Environmental Services declared the home habitable in July of 2008 (16 months after the oil spill), they also stated publicly that the home might still smell strongly of fuel oil when the cleanup is finished. The Demers’ home had no vapor barrier below it & no venting system below its foundation after the remediation was completed. The NHDES recommended a venting system be placed below the foundation in a letter from NHDES dated January 8, 2008. "We also recommend a soil vapor extraction system be installed to eliminate the vapors from migrating into the living areas of the residence" The NH Eagle Tribune December 26, 2007. Cleanup from heating oil spill drags on nearly one year later. Eagle Tribune reported the following: “Nearly a year after a home heating oil spill at the home of Michael Demers, the house still reeks of petroleum, and several environmental officials said it might stay that way.” In another comment from Bill Evans from the Department of Environmental Services he states: “I've never had (a cleanup) that's gone on this long, where the individuals have been displaced this long,” said Bill Evans, an oil spill expert with the state Department of Environmental Services. Stating further “That means the house might still smell strongly of fuel oil when the cleanup is finished. As long as air quality reports show the pollutants are within state guidelines, there's nothing regulators can do,” Evans said. “Aesthetically, there may be odors that are noxious, or at least not aesthetically pleasing,” he said. House Not Livable 14months after spill Oil sullied Salem residence last year. Eagle Tribune reported the following: “Bill Evans of the state Department of Environmental Services said he has never seen a home heating oil spill take so long to deal with. Evans has been overseeing the cleanup process since the spill. “Back a number of years ago, the longest I had was somebody was out of the house six months,” Evans said. The state oil specialist added that the cleanup company, Enpro Environmental Services, has conducted its work “piecemeal,” which likely slowed the process down.” “They seem to have managed the site kind of piecemeal,” Evans said. “So, at one point, they would excavate one area and at another point they would excavate another spot.” Please use link below to read this and other news articles relating to the oil spill, cleanup and court case that followed. https://www.yumpu.com/en/document/view/59736542/haffners-oil-spill-news-articles-2007-2018/2018-news-stories-oil-spill-leaves-family-fuming Haffner’s Oil company and Acadia Insurance Company refused to put Mrs. Demers family home back in the same position it was prior to this oil spill. Mr. Perreault’s Trial Testimony March 23, 2018 Mr. Demers question: Why did you or Acadia discontinue paying hotel bills in March of 2007? Mr. Perreault answer: “We discontinued paying hotel bills because Tom Wigglesworth was giving him information that you were interfering with the cleanup process.” Mr. Demers question: Mr. Perreault at what time period? The spill occurred on February 6, 2007 and after March 7, 2007 a month period. Can you explain how Mr. Demers interfered with the cleanup as you stated? Mr. Perreault answer: Well, as I testified earlier there were times when you would not show up and you had the keys to the home. So, when you were not there they could not go in and clean. You were, when people were there you were taking photographs of them and video and more or less getting in the way. There were personal items that were left in the home that needed to be moved in order for the home to be cleaned and that you did not do. Mr. Demers question: Mr. Perreault what was Mr. Demers supposed to do with personal items involved in an oil spill cleanup? Which items are you referring to? Personal items I was supposed to remove? We were in a hotel Mr. Perreault and your cleanup contractor was managing the property and the cleanup. Do you think it was the Demers’ responsibility to remove furniture or stuff from the home other than the clothes off our back that we took to the hotel room? Mr. Perreault answer: They had to have these articles removed to clean the home and they did not feel comfortable removing these personal items. Mr. Demers question: Mr. Perreault. We took the clothes off our back and stuff from draws and went to a hotel and your manager was in charge of the cleanup and would report to you. Correct? Mr. Perreault answer, Correct Mr. Demers question: Ok. So how did Mr. Demers in that one-month period interfere cause he took pictures you are saying? How did I interfere by taking pictures of the family home while this was going on, this tragedy was going on? Mr. Perreault answer: Not the family home, but the people who were working in the home in the house. Mr. Demers question: Did you know that Mr. Demers took the keys away from the environmental contractors in May when they re-excavated another excavation that they declared clean? Enpro in the first month had the whole run of the home. Mr. Perreault answer: No, I was not aware of that. Mr. Demers question: So, I don’t see how I interfered. I took pictures. What else did I do to interfere with the cleanup of the home? Mr. Perreault answer: Like I said, you would not show up and unlock the house for the cleaners and the personal property that was supposed to be removed. So, they could clean the place properly was not removed and I had contacted you about that and basically you were just protracting out your stay at the hotel. They the Demers’ wanted their home back the way it was before the oil spill. Mr. Demers alleges that he took the keys away from the contractors in late May of 2007 and began filming on May 3, 2007 after the contractors Enpro and Ambrose declared the cleanup was completed on February 28, 2007 and said that the only thing left was a final cleaning of the home and then in early May they began re- excavating an area in the basement that was previously declared clean and where confirmatory soil samples were collected. After Mrs. Demers’ home owners insurance company Maine Mutual Group ("MMG") hired an expert from Air Quality Management Inc. and discovered the property was in fact not cleaned. In the document you will see that the cleanup was complete and the only thing left was a final cleaning of the home. Go to - http://www.haffnersoilspill.com/clean_up_videos.html t See - Mr. Demers began filming the cleanup on May 3, 2007 Mr. Demers alleges that he had the environmental manager Mr. Wigglesworth's cell phone number, his work number and his home number and was in constant contact with him and had well over 100 conversations with him during the course of the cleanup. He also had Dr. Browns’ from Enpro cell phone number. Mr. Demers alleges he had missed one day a year after the oil spill and was late one time and informed Mr. Wigglesworth and Dr. Brown prior to the contractors coming to the home. The contractors were at the home 0ne hundred and thirty-five times. In addition, Mr. Demers was sent weekly work schedules from Enpro after Mr. Demers had a meeting with the Department of Environmental Services on April 5, 2007 and requested that the contractors provide him with times, dates and deadlines for the work to be completed. If Mr. Demers interfered with the cleanup, then why didn’t the environmental manager Mr. Wigglesworth’s tell the Eagle Tribune or the Union leader newspaper reporter that Mr. Demers was interfering with the cleanup when they interviewed him and asked about the lengthy cleanup? (See – Mr.Wigglesworth’s comments above) Why did Bill Evans from the Department of Environmental Services tell the Eagle Tribune the following? “Bill Evans of the state Department of Environmental Services said he has never seen a home heating oil spill take so long to deal with. Evans has been overseeing the cleanup process since the spill. “Back a number of years ago, the longest I had was somebody was out of the house six months,” Evans said. The state oil specialist added that the cleanup company, Enpro Environmental Services, has conducted its work “piecemeal,” which likely slowed the process down.” “They seem to have managed the site kind of piecemeal,” Evans said. “So, at one point, they would excavate one area and at another point they would excavate another spot.” In March of 2007, Mrs. Demers’ hired two public adjusters Phillip Mc Rae of Affiliated Public Adjusters and his partner Tony Madellini. Mrs. Demers’ insurer Maine Mutual Group ("MMG”) would send checks directly to them. The Public Adjusters were handling the loss for Mrs. Demers’ and received 10 % on property and personal property claims. In April of 2007, Mrs. Demers was in credit card debt and worried sick about her home and her being able to afford hotel bills. The Demers’ had a meeting on April 5, 2007 with 5 members of New Hampshire Department of Environmental Services ORCB (Oil Remediation Compliance Bureau). The Demers complained they were getting sick from strong odors in the home and were concerned that the contractors declared the oil spill was cleaned up on February 28, 2007. MMG insurance had hired an independent expert from Air Quality Management in March of 2007 to test the property and the expert discovered elevated levels of oil related chemicals in the air in the home and the property was in fact not clean. Report of March 12th 2007 Mrs. Demers had to pay her hotel bills out of pocket with a credit card from mid-March 2007 until early May 2007. Mrs. Demers was forced to wait a couple months before Maine Mutual Group ("MMG") would finally begin to send payments out of her ALE coverage homeowner’s insurance policy of $53,200. In May of 2007, Mrs. Demers' homeowners' insurance provider began paying the hotel bills for Mrs. Demers, Mr. Demers and Gerald Troisi, only after she submitted her credit card statements showing payments made to Stay bridge Suites hotel would MMG send payments and reimburse her several weeks later, Mrs. Demers had to repeatedly do this as the cleanup dragged on fourteen-months. Mrs. Demers had to pay a 15% interest rate on her credit cards. MMG would not set up a direct payment plan with the Stay bridge Suites hotel. During the course of the fourteen-month cleanup, Air Quality Management was sent five times by MMG Insurance to the Demers’ family home and each time they discovered the property was not clean and more work needed to be done to be in compliance with the New Hampshire Department of Environmental Services soil and ground water remediation standards. In addition to hotel payments, Mrs. Demers also had to pay her mortgage on her home at the time and by October of 2007 Mrs. Demers was still in credit card debt and time all four of Mrs. Demers’ credit cards were maxed out and the $53,200 was exhausted and Mrs. Demers was worried sick. The Demers’ retained an attorney and on November 1, 2007, a letter was sent by Mrs. Demers attorney to Leo Perreault of Acadia Insurance Company. On October 10, 2007 Mr. Demers sent a letter to the Honorable Senator Judd Gregg of New Hampshire asking for assistance. During this time, Mrs. Demers’ public adjusters began to request MMG insurance to provide partial payments for undisputed damages to her property and/or personal property to Mrs. Demers to cover hotel and living expenses and her mounting credit card debt and they agreed to send partial payments. After the more than fourteen-month cleanup was completed the Demers’ and MMG insurance still had serious concerns regarding the contamination on the property and MMG insurance hired an independent expert from Shaw Environmental & Infrastructure, Inc.to to review Enpro reports to do further testing at the property. The document email sent to Mr. Demers on January 30th, 2009 from Phil McRae, Affiliated Public Adjusters, (Mrs. Demers’ public adjuster) nearly two years after the oil spill. It is an itemized breakdown showing where and what and who the money was paid on behalf of Mrs. Demers by her insurance company MMG Insurance Company. Mr. Demers alleges the $28,438.95 that was to be paid to Mrs. Demers for personal property damages. But, at that time in January of 2009, Mrs. Demers was in debt and was told by MMG that she would be required to first purchase each personal property item and submit a receipt. Then after they received the receipt that they would send payment to her. Unfortunately, Mrs. Demers was unable to do this at the time because of the debt she was in. So, she did not receive any of the $28,438.95. from MMG to pay for her damaged personal property. Meanwhile, the Demers’ family were still living in a hotel and forced to use money from Mrs. Demers MMG insurance policy that would have been used to pay for property damages. The Demers’ remained in the hotel for 28 months until a mobile home became available in August 2009 and was placed in front of the Mrs. Demers’ home. So, she could be close to her home until the negligence trial began nearly five years after the oil spill. Mrs. Demers did not use any of the money she received to do any repairs to the home. The Demers’ lost the 2011 negligent case against Haffner's Oil Company, Acadia Insurance Company, Ambrose Environmental Management, Inc. and Enpro, Services. Mrs. Demers went bankrupt in 2014 after being out of her home for nearly seven years. By then she was in over $200,000.00 in debt as a result this oil spill and having to spend a part of the money she received from MMG her home owners insurance company settlement and pay the hotel bills, storage for the entire contents of her home, and the remainder she paid out of pocket and on credit cards for alternate living expenses while waiting nearly five years to go to trial with the companies. Mrs. Demers insurance policy with MMG Insurance ALE coverage was $53,200. So, Mrs. Demers was stuck paying above and beyond $53,200 that ran out in early October 2007 while the cleanup was going on. The cleanup was completed six months later on April 20, 2008. Acadia Insurance Company paid a total of $532,000 on behalf of its insured, Haffner's, for the claim arising out of the Oil Spill. The breakdown of Acadia's payments is as follows: $72,000 to Ambrose, $325,000 to Enpro, and $135,000 to MMG. After the remediation of Mrs. Demers' home, Acadia reimbursed MMG $135,000 that had been paid to Ms. Demers. Acadia reimbursed MMG because this oil spill was a 100 percent covered loss. and they were liable for the loss. Acadia Insurance Company and Haffner’s Oil Company refused to put Mrs. Demers’ Home back in the position it was before the oil spill. How much Acadia Insurance Company spent fighting the Demers’ Negligent Lawsuit is unclear? It is our opinion that the verdict in the 2011 Negligence Case against Haffner's Oil Company, Acadia Insurance Company, Ambrose Environmental Management, Inc. and Enpro, Services, Inc. was wrong and a Great Injustice! Half of her personal belongings are still in a storage container in the driveway of her home. Her homes foundation is permeated with the smell of #2 fuel oil and there is a notable fuel odor when entering the breezeway of the home, in the kitchen and the entire basement smells of oil which is currently sealed off from the upper level of the home.
