Still Lake v Hobbs (095403) but on the signature count: ballot envelope signatures must be verified. Originally Judge Thompson dismissed it on laches (filed too late) but the AZ Supreme Court corrected him: if Lake challenged the election rules only after she lost, *that* would be laches, but she was challenging the application of the rule/law (law says follow EPM and EPM says how and what to check). Thompson then warped the plaintiffs' argument when he set the hearing, saying they must prove NOT ONE SIGNATURE was checked. But the legal standard is *substantial* compliance, not *any* compliance, so Thompson's standard was NOT the established legal standard. Was there SUBSTANTIAL compliance with the EPM's signature verification procedures? should have been what Lake had to prove. Likewise in the first trial, Thompson set two new standards for Lake to prove: 1. she had to have "competent mathematical" basis for doubt, not just basis for doubt; 2. she had to prove intentionality. So the question arises, why did Thompson reverse the case law in both of these rulings? He reversed THREE DIFFERENT LEGAL STANDARDS in one case and further got the law wrong on signature comparison: they must be compared with the registration signature by AZ law and previous mail-in ballot signatures have nothing to do with registration process, therefor they're not reg signatures. Not sure how much Lake's team argued this but if they didn't, that probably had to do with the tight line Thompson made them walk. He threw out Ryan Heath's amicus brief as I recall and wouldn't even let Heath say anything. Similarly, Judge Hannah in Lake III shut down all discussion of proper signature comparison.
